Description: Platted parcels within the City of Albuquerque that contain Small Loan Business locations. These locations were originally identified from the Small Loan Licensee Directory produced by the New Mexico Regulations & Licensing Department: Financial Institutions Division in December 2014. As described by the Financial Institution Division, Small loan companies are businesses licensed to make loans of $2,500 or less to New Mexico consumers. These companies are licensed and regulated as per the provisions enacted in the New Mexico Small Loan Act of 1955 §58-15-1 NMSA 1978. Small Loan Companies typically offer a variety of different loan products that may include Payday Loans, Car Title Loans, Installment Loans, or Refund Tax Anticipation Loans. Each business is required to submit an initial and annual license application, along with the appropriate fee, to the Director of the Financial Institutions Division. Banks, Savings and Loan and Credit Unions shall be exempt from the licensing requirements. Small loan businesses located in the City of Albuquerque must also meet all the requirements outlined in the City of Albuquerque Zoning Code. City Council Ordinance O-2015-002 amended the Zoning Code to Regulate Small Loan Businesses. This Ordinance was adopted in January 2015. In order to determine that new Small Loan Businesses meet the requirements listed in the Ordinance, it was necessary to map the locations of existing small loan businesses based on the addresses provided from the Small Loan Licensee Directory. The locations that didn't match to a valid AGIS address were field verified in Spring 2015. The Ordinance states that new small loan businesses must not be located on the same parcel as another small loan business, nor closer than one mile as measured in a straight line from property line to property line, to any other parcel on which another small loan business is located. The Zoning Enforcement Officer will conduct and annual review at which time this feature class will be updated, but there may be minor updates periodically throughout the year. Any small loan business in operation prior to the effective date of this Ordinance will be considered a noncoforming use, but are still subject to annual reporting requirements.
